    Hathras gang rape case|Mathura Court rejects bail plea of 3 declared PFI guys

    A Mathura Court on Friday turned down the bail plea of three males who were scheduled and jailed in addition to a Kerala reporter while they were going to a village in Hathras to meet the member of the family of an declared gang rape and murder victim

    At first detained on October 5 under Section 151 of the CrPc, all the four men were later on reserved under sections 124- A (sedition), areas 153 A (promoting enmity), 295 (outraging religious feelings) of IPC and areas 65, 72 and 75 of the IT Act.

    Eventually, the stringent Unlawful Activities (Prevention) Act 1967 (UAPA) was also invoked against them. Cops claimed that all became part of Popular Front of India (PFI) and School Front of India (CFI).

    Judge Mayur Jain pointed out the gravity of charges while declining the bail applications Atif-ur-Rahman, Masood Ahmad, and Mohammad Alam. The Court delivered three different orders however all of them specified that the bail pleas were accountable to be turned down due to the embargo developed under Area 43- D (5) of the UAPA that the Court could not give bail.

    Defence lawyer Madhuvan Chaturvedi said they will approach the High Court for the bail.

    ” A habeas corpus petition of the 3 guys is already noted in the Allahabad High Court and the hearing is on November 17,” he stated.

    Mr. Kappan’s petition is noted in the Supreme Court and is likely to be heard on November 16.
